STORE TERMS & CONDITIONS

- GENERAL PROVISIONS
1.1. These Terms & Conditions govern the use of the online store located at www.dalivalley.com (the “Store”).
1.2. The Store is operated by Dali Valley. By using this Store, you agree to these Terms and all applicable laws and regulations.
1.3. By placing an order, the Customer confirms they have read, understood, and accepted these Terms & Conditions in their entirety.
1.4. We reserve the right to update these Terms at any time. The version in effect at the time of your purchase will apply to your order.
- NATURE OF PRODUCTS
2.1. Print-on-Demand (POD): The Customer acknowledges that all physical apparel and merchandise (T-shirts, hoodies, etc.) are custom-manufactured specifically for each order. We do not maintain a physical inventory of pre-printed goods.
2.2. Digital Products: The Store sells digital downloads (art files, graphics). These are delivered electronically and are not physical objects.
2.3. Variations: Due to the nature of DTG (Direct-to-Garment) printing and digital screen settings, slight variations in color, placement, and size of the print may occur. These are not considered manufacturing defects.
- CUSTOMER RESPONSIBILITIES
3.1. Information Accuracy: The Customer must provide an accurate shipping address, email, and phone number. We are not responsible for delivery failures due to incorrect information provided by the Customer.
3.2. Eligibility: By placing an order, you represent that you are at least 18 years of age or have parent/legal guardian permission to use this Store.
- PRICES & PAYMENTS
4.1. Currency: Prices are displayed in USD.
4.2. Taxes: * USA: Sales tax may be applied at checkout depending on the laws of the destination state.
4.3. Payment Security: Payments are processed through secure third-party providers (e.g., Stripe, PayPal). We do not store or have access to your full credit card details.
- SHIPPING & DELIVERY
5.1. Total Timeline: Delivery consists of two parts: Production Time (2–5 business days) + Shipping Time (varies by destination).
5.2. USA Delivery: Typically 4–10 business days after production via tracked services (e.g., USPS, DHL).
5.3. Risk of Loss: Once the carrier marks a package as “Delivered,” DaliValley is no longer responsible for the package. We are not liable for “porch piracy” or theft after delivery.
5.4. Incorrect Address: If a package is returned to the supplier due to an incorrect address provided by the Customer, the Customer is responsible for the cost of re-shipping.
5.5 Delivery delays: We are not liable for shipping and delivery delays. All delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers, customs processing, or events outside our control. Once we transfer products to the carrier, title and risk of loss passes to you.
- RETURNS, EXCHANGES & REFUNDS
6.1. Final Sale Policy: Because products are custom-made for you and digital files are delivered instantly, we do not accept returns or exchanges for change of mind, incorrect size selection, or color preference.
6.2. Manufacturing Defects: If an item arrives damaged, defective, or misprinted, we offer a free replacement or full refund.
- Claims must be sent to support@dalivalley.com within 14 days of delivery.
- You must provide clear photo evidence of the defect and the shipping label.
6.3. Digital Items: All sales of digital products are final. Once the download link has been accessed, no refunds will be issued.
- INTELLECTUAL PROPERTY
7.1. All designs, logos, and content on this website are the intellectual property of DaliValley.
7.2. Digital Product License: Purchasing a digital file grants the buyer a personal, non-transferable license. You may not resell, redistribute, or use the designs for commercial purposes unless explicitly stated otherwise in a separate license agreement.
- LIMITATION OF LIABILITY
8.1. DaliValley provides the Store and its products on an “as-is” basis.
8.2. To the maximum extent permitted by law, DaliValley shall not be liable for any indirect, incidental, or consequential damages (including loss of profits or data) arising from the use of our products or the inability to use the Store.
- PRIVACY & DATA PROTECTION
9.1. We process personal data according to the applicable US privacy standards.
9.2. We share necessary data (name, address) with our printing partners (e.g., Printify/Monster Digital) solely for the purpose of fulfilling your order. Please see our Privacy Policy for full details.
- APPLICABLE LAW & JURISDICTION
10.1. Informal Resolution: In the event of any controversy, claim, action, or dispute arising out of or related to any transaction conducted on the Store, the parties shall first attempt to settle such dispute in good faith by providing written notice to the other party (support@dalivalley.com) describing the facts and allowing the receiving party 30 days to respond.
10.2. Binding Arbitration: If a resolution cannot be reached through informal negotiation, all disputes shall be resolved through binding arbitration rather than in court. The arbitration shall be conducted on an individual basis (no class actions). This means you and DaliValley waive the right to a trial by jury or to participate in a class-action lawsuit.
10.3. Governing Law: These Terms and any dispute of any sort that might arise between you and DaliValley shall be governed by and construed in accordance with the laws of the jurisdiction where the Store owner is registered, without regard to its conflict of law principles.

We reserve the right, in our sole discretion, to update, change, or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to the Services following the posting of any changes to these Terms of Service constitutes acceptance of those changes.
